SaferNet analyzed them and found that 149 of them were still active and had not been restricted by the platform. A report drawn up by SaferNet, an NGO active in promoting human rights online since 2005, found that 1.25 million users of the messaging app Telegram are in group chats or channels that sell and share images of child sexual abuse and pornographic material. One of these communities alone—which was still active when the survey was made—had 200 thousand users.

Those numbers may be an undercount, however, as the images are so realistic it’s often difficult to tell whether they were AI-generated, experts say. But experts say more should have been done at the outset to prevent misuse before the technology became widely available. And steps companies are taking now to make it harder to abuse future versions of AI tools “will do little to prevent” offenders from running older versions of models on their computer “without detection,” a Justice Department prosecutor noted in recent court papers. CSAM is illegal because it is filming an actual crime (i.e., child sexual abuse). Children can’t legally consent to sexual activity, and so they cannot participate in pornography. It may also include encouraging youth to send sexually explicit pictures of themselves which is considered child sexual abuse material (CSAM). The U.S. Department of Justice defines CSAM, or child pornography, as any sexually explicit images or videos involving a minor (children and teens under 18 years old). The legal definition of sexually explicit does not mean that an image or video has to depict a child or teen engaging in sex. A picture of a naked child child porn may be considered illegal CSAM if it is sexually suggestive enough.

It is also important to recognize the risk of youth crossing boundaries with other youth online. Youth can also face legal consequences for child sexual abuse material despite their own status as a minor. The prosecutions come as child advocates are urgently working to curb the misuse of technology to prevent a flood of disturbing images officials fear could make it harder to rescue real victims. Law enforcement officials worry investigators will waste time and resources trying to identify and track down exploited children who don’t really exist. To be considered child sexual abuse there does not have to be penetration to the vagina or anus.
